These Terms and Conditions ("Terms") govern your use of the website and/or application operated by Nigce Technologies Pvt Ltd ("Company", "we", "us", or "our"), having its registered office at B-049, BETA-1, GREATER NOIDA, Gautam Buddha Nagar, Uttar Pradesh, India, 201308.

1. Change and Update of Registered Website/App URL

1.1 We, Nigce Technologies Pvt Ltd, hereby represent, warrant, confirm, declare, and undertake that:
a) We want to change and update our old registered website/App URL from www.erpawan.com to our new website/App URL https://nigcecard.com/.
b) The business model of our new website/App URL includes IT Services, ERP Software, Digital Card, AI Form, etc.
c) PG services will be used exclusively on our new website/App URL (https://nigcecard.com/) for the above-mentioned business services and not on any other website/App URL or for any other business. - Once your refund request is approved, we will process the refund within 7 business days.

2. Content and Compliance

2.1 We expressly warrant that our platform shall not contain any material that is offensive, derogatory, explicit, perverse to any specific race, gender, or class of persons, or degrading to public conscience or morals.
2.2 We assure that we possess all the requisite rights and interests in the content provided on our platform.
2.3 Our platform shall be in conformity with Indian sentiments and legal standards.

3. Authority

3.1 We warrant that we possess the exclusive authority to sign documents and agreements on behalf of Nigce Technologies Pvt Ltd.

4. Governing Law and Jurisdiction

4.1 These Terms and Conditions are governed by and construed in accordance with the laws of District Court of Gautam Budha Nagar, Uttar Pradesh India , without regard to its conflict of law principles. By using Nigce Card, you agree that any disputes arising out of or relating to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts located in Greater Noida Uttar Pradesh, India.
4.2 Nigce Card reserves the right to terminate or suspend your access to our services, with or without notice, for conduct that we believe violates these Terms and Conditions, is harmful to other users of Nigce Card, or is harmful to the interests of Nigce Card. Upon termination, your right to use Nigce Card will immediately cease. If you wish to terminate your account, you may discontinue using the service at any time.
4.3 The legal name of the merchant providing services under Nigce Card is Nigce Technologies Pvt. Ltd., registered in [Greater Noida, Uttar Pradesh, India]. All payments and transactions processed through Nigce Card will be handled by Nigce Technologies Pvt. Ltd.
4.4 All content, trademarks, service marks, trade names, logos, and intellectual property rights associated with Nigce Card are the exclusive property of Nigce Technologies Pvt. Ltd. or its licensors. You may not copy, modify, distribute, or use any of our intellectual property without our prior written consent. Unauthorized use may violate copyright, trademark, and other applicable laws and result in criminal or civil penalties.
4.5 To the maximum extent permitted by applicable law, Nigce Technologies Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available via the service. In no event shall Nigce Technologies Pvt. Ltd.’s total liability to you for all claims, damages, or causes of action exceed the amount you have paid to Nigce Technologies Pvt. Ltd. in connection with the use of Nigce Card in the twelve (12) months immediately preceding the claim.
